USER AGREEMENT
This User Agreements is entered into between IT recruiting agency Gravity Agency LLC (“The Gravity Agency”) and a user/visitor of the website at www.hirethegravity.com (the “Website”), that is a person that uses the Website/visits the Website/browses the Website pages and/or uses at least one of the Website capabilities and/or uses at least one of the Website services.
This User Agreement regulates the procedure for using the Website, the Website services, and the Website capabilities. The Website articles and e-mails refer to this User Agreement as “The Website Rules.”
1. The Website User/Visitor
1.1. The Website user/visitor is any person who uses/visits the Website (browses the Website, etc.) for any reason and without registering/authorizing on the Website.
1.2. The Website user/visitor accedes to this User Agreement by using/visiting the Website and/or posting/specifying/notifying any of his/her personal data on the Website and/or through the Website feedback form and/or by e-mail to the e-mail address(es) displayed on the Website. By using/visiting the Website and/or posting/specifying/notifying any of his/her personal data on the Website and/or through the Website feedback form and/or by e-mail to the e-mail address(es) displayed on the Website, the Website user/visitor acknowledges that the Website user/visitor is aware of, agrees to and accepts the terms and conditions of this user Agreement.
1.3. If the Website user/visitor does not accept the terms and conditions of this User Agreement/refuses to accept the terms and conditions of this User Agreement, such Website user/visitor has no right to use the Website and/or the Website capabilities/services. The Gravity Agency and/or the Website Administration and/or the Website are/is not liable to the Website user/visitor, if the Website user/visitor does not accept the terms and conditions of this User Agreement/refuses to accept the terms and conditions of this User Agreement.
1.4. If the Website user/visitor has not reached the age specified by the law of Ukraine for entering into such agreements and/or violates applicable laws of Ukraine in terms of entering into such agreements, such Website user/visitor may not use the Website capabilities/services and may not accede to this User Agreement.
2. Rights and Obligations of the Website User/Visitor
2.1. The Website users/visitors that accept the terms and conditions of this User Agreement have the right to use/visit the Website and to use the Website capabilities/services.
2.2. The Website user/visitor has the right to:
2.2.1. use/visit the Website, provided that the Website user/visitor accepts the terms and conditions of this User Agreement;
2.2.2. leave requests for information in accordance with the Website capabilities and the terms and conditions of this User Agreement, through the Website feedback form and/or by e-mail to the e-mail address(es) displayed on the Website;
2.2.3. use the Website services taking into account the Website capabilities and the terms and conditions of this User Agreement, subject to compliance with applicable laws of Ukraine.
2.3. The Website user/visitor undertakes to:
2.3.1. Not mislead/deceive the Website users/visitors and/or the Website Administration and/or The Gravity Agency.
2.3.2. Not send for posting any deliberately false or distorted information.
2.3.3. Write words in capital letters only if they are abbreviations.
2.3.4. Not send any messages that contain calls to violate Ukraine’s integrity, suggest to recognize illegal administrative-territorial entities on the territory of Ukraine, include symbols and propaganda of separatist or terrorist organizations.
2.3.5. Not send any information aimed at collecting and storing personal data concerning the Website users/visitors.
2.3.6. Use the Website in compliance with applicable laws of Ukraine, and not violate the rights of The Gravity Agency and/or the Website Administration and/or the Website and/or third parties.
2.4. Any copying of information/materials posted on the Website is prohibited.
2.5. Unless specified otherwise, the intellectual property rights to any information/materials posted on the Website belong to The Gravity Agency and/or the Website Administration and/or the Website owner. The rights to names, titles, trademarks registered in accordance with the procedure established by the law of Ukraine belong to their legal owners in accordance with applicable laws of Ukraine. The Website can choose not to use any legal protection marks for their designation.
2.6. By posting/specifying/communicating any of his/her personal data on the Website and/or through the Website feedback form and/or by e-mail to the e-mail address(es) displayed on the Website, the Website user/visitor acknowledges and warrants that his/her personal data and information provided by the Website user/visitor are up-to-date, complete and accurate, and that any provision of such information fully complies with applicable laws of Ukraine and does not violate any provisions of applicable laws of Ukraine and third party rights.
2.7. The Gravity Agency and/or the Website Administration have/has the right to delete any of the Website user’s/visitor’s massages/ads/information posted on the Website at their/its sole discretion.
2.8. If the Website user/visitor considers that the information on the Website violates his/her rights and/or applicable laws of Ukraine, the Website user/visitor has the right to file a claim to the Website Administration, stating in detail the reasons for such a claim and indicating his/her rights that are violated, by e-mail to the e-mail address displayed on the Website in the Contacts section of the Website.
3. The Website Terms of Use
3.1. When using the Website, the Website user/visitor is obliged to comply with the provisions of applicable laws of Ukraine, third party rights, and also the rules and restrictions stipulated by this User Agreement. Ignorance of the laws of Ukraine, rules and restrictions stipulated by this User Agreement is not an excuse for the Website user’s/visitor’s noncompliance, as well as does not excuse from liability for any violation thereof.
3.2. The Website user/visitor may not use the Website, the Website services, and information published on the Website for any purposes that do not comply with the laws of Ukraine, or in violation of the laws of Ukraine and/or third party rights.
3.3. When using the Website, the Website user/visitor is prohibited from:
3.3.1. Publishing any calls for violent change or overthrow of the constitutional order, take-over of government, change of the state border of Ukraine, destruction of property, take-over of buildings or structures, aggression or unleashing of a military conflict, violation of third party rights, violation of applicable laws of Ukraine, or other actions, and publishing any communications, etc. that are contrary to the laws of Ukraine.
3.3.2. Posting offensive and/or obscene messages/ads/information.
3.3.3. Posting ads.
3.3.4. Posting information/messages for commercial purposes.
3.3.5. Posting/providing information that is untrue and/or inaccurate.
3.3.6. Posting/providing information that shows any signs of discrimination based on nationality, ethnicity, religion, or race.
3.3.7. Posting/providing/using information in violation of intellectual property rights.
3.3.8. Posting on the Website links to any website(s) or information that violate(s) applicable laws of Ukraine and/or third party rights.
3.3.9. Posting/publishing information on behalf of The Gravity Agency and/or the Website Administration.
3.4. The Website/the Website sections may be moderated/adjusted at the discretion of The Gravity Agency and/or the Website Administration without any restrictions and/or prior notifications, unless otherwise provided by applicable laws of Ukraine.
3.5. The Gravity Agency and/or the Website Administration also have/has the right to change the Website at their/its sole discretion, to change the cost, type of services and their validity period, to use the information sent by the Website user/visitor, for example, post it on partner websites, and to amend this User Agreement independently and at their/its sole discretion.
4. Liability
4.1. The Website user/visitor who provides and/or posts information is solely liable for the accuracy and relevance of such information provided and/or posted by such Website user/visitor.
4.2. The Gravity Agency and/or the Website Administration are/is not liable for the Website user’s/visitor’s actions, use of the Website and its features and services, information provided and/or posted by the Website user/visitor, and any violation of the laws of Ukraine and/or third party rights by the Website user/visitor. Moreover, The Gravity Agency and/or the Website Administration are/is not liable for the content of materials sent by the Website user/visitor and for any damage and/or any other direct and/or indirect losses incurred and/or that may be incurred by the Website user/visitor and/or any third party, which may result from the use of the Website, and are/is not liable for any lost profits.
4.3. The Website user/visitor is liable under applicable laws of Ukraine.
4.4. The Website user/visitor understands and agrees that the Website user/visitor is solely liable for any violation of his/her obligations under this User Agreement, as well as for any consequences of using the Website and/or violating the terms and conditions of this User Agreement, including any losses, damages, lost profits, etc. incurred by The Gravity Agency and/or the Website and/or the Website Administration, and that The Gravity Agency and the Website Administration are not liable to the Website user/visitor and/or third parties in case of the Website user’s/visitor’s use of the Website and/or violation of any provisions of the laws of Ukraine and/or the terms and conditions of this User Agreement and/or third party rights.
5. Processing of Personal Data
5.1. The Consent to Personal Data Processing published on the Website constitutes an integral part of this User Agreement.
5.2. Any information provided/posted by the Website user/visitor may be publicly available to all users/visitors of the Website. By providing/posting information (including personal data) on the Website and/or through the Website feedback form and/or by e-mail to the e-mail address(es) displayed on the Website, the Website user/visitor acknowledges and agrees that such information may be publicly available and that the Website user/visitor does not object to the public availability of such information.
5.3. In certain cases, The Gravity Agency and/or the Website Administration may cooperate and interact with and transfer data to its partners, clients and contractors, provided that such partners, clients and contractors’ rules for processing and storing personal data comply with the legislative requirements and the terms and conditions for personal data processing stipulated by this User Agreement. In such cases, The Gravity Agency and/or the Website Administrationshall ensure(s) that appropriate measures are taken in order to protect such data.
5.4. In addition to the purposes specified in the Consent to Personal Data Processing, personal data and information may also be used for the following purposes:
5.4.1. publishing the Website users’/visitors’ resumes and/or job vacancies;
5.4.2. ensuring proper functioning of the Website, including statistical purposes;
5.4.3. contacting the Website users/visitors;
5.4.4. obtaining information by the Website users/visitors;
5.5. Storage periods for data is established by The Gravity Agency and/or the Website Administration under applicable laws of Ukraine and may differ.
6. Confidentiality
6.1. The Gravity Agency’s Personal Data Privacy Policy published on the Website constitutes an integral part of this User Agreement. The procedure for collecting, using and disclosing any information that is confidential is carried out in accordance with The Gravity Agency’s Personal Data Privacy Policy published on the Website.
6.2. By accepting the terms and conditions of this User Agreement, the Website user/visitor acknowledges and agrees to the terms and conditions of The Gravity Agency’s Personal Data Privacy Policy and Consent to Personal Data Processing that are published on the Website. Any collection, storage, use, processing, and disclosure of information received by The Gravity Agency and/or the Website Administration as a result of the Website user’s/visitor’s use of the Website is carried out in accordance with applicable laws of Ukraine.
7. Cookies
7.1. In order to improve the Website functioning and/or the Website services, we collect some information sent from the Website user’s/visitor’s browser (cookies). The Website user/visitor can, if wishes so, disable cookies (in the settings of the Website user’s/visitor’s browser). Disabling cookies may restrict the Website user’s/visitor’s use of the Website’s functionality.
8. Other
8.1. The Website Administration has the right to terminate this User Agreement or modify any terms and provisions of this User Agreement at any time and at its sole discretion.
8.2. Any use of the Website by the Website user/visitor means, whatever the case may be, that the Website user/visitor automatically accedes to this User Agreement, accepts and agrees to the terms and conditions of this User Agreement. In case of using the Website, the Website user/visitor understands and agrees that The Gravity Agency and/or the Website Administration consider(s) such Website user’s/visitor’s use of the Website as accession to this User Agreement and agreement to all the terms and conditions of this User Agreement from the beginning of the use of the Website.
8.3. The Administration can be contacted by e-mail to the e-mail address(es) displayed on the Website. Any claims will be addressed in accordance with the procedure established by applicable laws of Ukraine.
8.4. The Gravity Agency and/or the Website Administration have/has the right to modify this User Agreement unilaterally and at their/its sole discretion. The text of the User Agreement posted on the Website is valid and up-to-date. The Website user/visitor agrees and acknowledges that the Website user/visitor becomes informed of any modifications to the terms and conditions of the User Agreement as soon as the modified version of the User Agreement is published on the Website.
